An uncontested divorce requires both parties to agree on all terms, including property division, spousal support, division of debt, child support, child custody, etc. Since one attorney cannot represent both spouses, we advise each spouse to have his or her own attorney. Even in an uncontested divorce, input from a family law attorney can be extremely helpful and even essential. Many uncontested divorces result in lopsided terms simply because one spouse did not fully understand his or her rights and what a reasonable agreement should include.
Couples who agree on all terms of their divorce will save time, money, and stress. But most importantly, they will likely be far more pleased with the outcome than if a judge enters an order mandating the terms. It is usually a preferred alternative to a contested divorce which can be an expensive and lengthy process.
